The European Audiovisual Copyright Landscape and Unwaivable Remuneration Rights, 7.10.2023
The implementation of the EU Copyright Directives was the opportunity to improve authors and performers’ position in the audiovisual industry. Some Member States have created distinctive mechanisms to secure fair and proportionate remunerations for authors and performers. Cécile Despringre will walk us through the current European audiovisual copyright landscape and give examples of value chain balancing for audiovisual authors.
Countries like Spain, Italy, The Netherlands and Slovenia have been regulating mandatory collective management of audiovisual authors’ remunerations for the exploitation of their works. In these countries, the right to fair remuneration is inalienable and nonwaivable by law. Authors’ CMOs negotiate those remunerations with broadcasters, distribution operators and on-demand platforms for their large repertoire. CMOs leverage authors’ negotiation power against global corporations. Fair copyright income to authors and performers is an efficient way of retaining talents in Europe and securing quality and growth for the national audiovisual industry. Without the well-being of creators, there are no stories to exploit.
Cécile Despringre studied International and European Law at the University of Paris I and holds a Master’s Degree in International Economic Law. She has worked for SACD and FERA, before being offered to set up and manage the SAA in 2010, the home for European collective management organizations of audiovisual authors in Brussels. The SAA gathers 33 collective management organisations in 25 countries and promotes a high level of protection of European screenwriters and directors and the collective management of their authors’ rights.
Taking on the Giants – Danish Author’s collective bargaining journey with a global streamer, 7.10.2023
The Danish audiovisual industry was in great turmoil in 2022. Productions were on hold, and creative workers were without income. The situation was caused by the demanding negotiations between streamers and local rightsholders. Danish authors and performers were striving for fair remuneration for the exploitation of their work. The situation was severe, and peers’ worries grew towards the end. Luckily, the counterparties agreed upon several deals, ending the lock-outs, and the triumph of Danish audiovisual content may continue.
Rasmus Kloster Bro was behind the scenes facing counterparties like Netflix, bargaining for a more balanced value chain and securing solid copyright income for his peers. In this keynote, he will share his journey in these negotiations. How to increase appreciation of creative workers’ input and deliver fair and proportionate remunerations? What to consider before challenging the global streamer’s playbook?

Creative Constraints and Managerial Aspects in the Finnish Audiovisual Industry, 6.10.2023
Over the past decade, the AV industries in the Nordic region have witnessed a consistent rise in new productions and the remarkable success of Nordic films and TV series. The industry’s growth, along with the digital revolution, and its inherent organizational traits, have impacted the well-being of creative professionals. In his study, Ph.D. Cañas-Bajo explored well-being and artistic freedom among Finnish creative AV workers. This assessment raises questions about necessary changes to foster industry sustainability, including enhancing leadership skills, improving employees’ work-life balance, and addressing the industry’s ingrained behavioral patterns.
Jose Cañas-Bajo, PhD, has graduated in Audiovisual Communication from the University of Málaga and holds a Master’s Degree in Scriptwriting for TV series at ESCAC, University of Barcelona. His doctoral thesis was completed at Jyväskylä University and explored viewers’ emotional experiences of audio-visual products across cultures. Currently, he is a grant researcher at Jyväskylä University, focusing on decision-making in film production.
Tietoisku käsikirjoittajien, näyttelijöiden ja ohjaajien kreditointiohjeesta, 6.101.2023
Avate on olla laatinut kreditointiohjeen osana OKM:n rahoittamaa metadatan keräämisen ja hyödyntämisen kehittämishanketta. Kreditointiohjeen tarkoituksena on selkeyttää kreditointiprosessia ja parantaa mahdollisuuksia puuttua virheellisiin tietoihin. Ohje antaa konkreettisen avun niin käsikirjoittajille, näyttelijöille ja ohjaajille kuin tuotantoyhtiöille ja jakelijoille. Tässä tietoiskussa esitellään ohjeen pääkohdat ja annetaan vinkit hyvin toteutettuun kreditointiin sopimusneuvotteluista jakeluun.
Riikka Koskinen on ollut laatimassa Avaten kreditointiohjetta vuonna 2023. Hän opiskelee Aalto-yliopiston Elokuvataiteen laitoksella, pääaineenaan elokuva- ja televisiotuotanto. Kandintyössään hän tutki näyttelijöiden tekijänoikeuksia ja jatkaa tutkimustaan gradussaan, jossa hän paneutuu taiteellisesti vastaavien tekijänoikeuskorvauksiin ja tekijänoikeuslain muutoksiin.
Anna Mellin on freelancer-käsikirjoittaja, joka on ollut laatimassa Avaten kreditointiohjeistusta vuonna 2023. Hänellä on kandin tutkinto elokuva- ja televisiotuotannon opinnoista ja maisterin tutkinto käsikirjoittamisesta Aalto-yliopiston Elokuvataiteen laitokselta. Annan kokemuksessa yhdistyy ymmärrys käsikirjoittajan työstä freelancerina ja tuotannollinen näkökulma erilaisista elokuvatuotannon sopimuskysymyksistä.
